Terms and conditions

Effective from 8 October 2026.

§1. Seller

The online shop memoriaarte.com is operated by Paweł Polak, a sole trader operating as PHU Paweł Polak, ul. Kazimierza Pużaka 26, 38-400 Krosno, Poland, tax ID (NIP) PL 6772025546, entered in the Polish Central Register of Business Activity (CEIDG). Contact: kontakt@memoriaarte.com.

§2. Definitions

Customer means a natural person, legal person or organisational unit placing an order. Consumer means a Customer who is a natural person concluding a contract not directly related to their business or profession.

Ready product means an urn sold without made-to-order decor and without personalisation. Personalised product means an urn with a decor, engraving or other change made to the Customer’s specification.

Configuration code means a code in the format MA-[form]-[decor]-[personalisation] that unambiguously describes the urn ordered. Item number means the individual number assigned to each urn sold.

§3. Technical requirements

To use the shop you need a device with internet access, an up-to-date browser with cookies enabled and an active e-mail address. Customers must not provide unlawful content, in particular in personalisation text.

§4. Orders and conclusion of the contract

Orders are accepted through the online shop at any time. The Customer chooses the urn form, decor and personalisation, provides delivery details and chooses a payment method.

Before placing the order, the Customer sees a summary with the price of each element, the configuration code, the delivery cost and method, and whether the right of withdrawal applies. Placing the order entails an obligation to pay.

The contract is concluded when the Customer receives the e-mail confirming acceptance of the order. The e-mail contains the configuration code and a link to these terms.

For a decor made to the Customer’s design (code DX) and for own artwork (G3), we send the Customer the design for approval. Work begins after approval and receipt of payment. If the design cannot be agreed, we refund the full amount paid.

§5. Prices and payment

Prices in the shop include VAT. The price consists of the base urn price and the prices of the selected options. The delivery cost is shown before the order is placed.

Payment is made in advance using the methods available in the shop, processed by imoje (ING Bank Śląski S.A.) and PayPal. When a price is reduced, we also show the lowest price from the 30 days before the reduction.

§6. Fulfilment and delivery

We deliver to Poland, Germany and France via DPD or DHL. Every parcel is insured.

Ready products are handed to the carrier within 24 hours, products with an engraved name, dates or inscription (G1, G2) within 72 hours, and products with a decor or own artwork within 5 working days of design approval and payment. Estimated delivery time after dispatch: Poland 1–2 working days, Germany 2–4, France 3–5.

Lead times for larger orders from businesses are agreed individually.

§7. Right of withdrawal

A Consumer may withdraw from a contract for a ready product within 14 days of receiving it, without giving a reason. The procedure and model form are set out in the Returns and withdrawal policy.

Under Article 38(1)(3) of the Polish Consumer Rights Act of 30 May 2014 (implementing Article 16(c) of Directive 2011/83/EU), the right of withdrawal does not apply to personalised products, i.e. goods made to the Consumer’s specifications or clearly personalised. We state this on the product page and in the order summary.

The rules on withdrawal also apply to a natural person concluding a contract directly related to their business where the contract is not of a professional nature for them (Article 38a of the Consumer Rights Act).

§8. Complaints

We are liable to Consumers for the conformity of the product with the contract under the Consumer Rights Act for 2 years from delivery.

Complaints can be sent to kontakt@memoriaarte.com, stating the item number and a description of the issue. We reply within 14 days. Natural variations in the grain and shade of ancient black oak and amber do not constitute a lack of conformity.

§9. Out-of-court dispute resolution

Consumers may seek assistance from the Provincial Inspectorate of Trade Inspection in Rzeszów, a district or municipal consumer ombudsman or consumer organisations in Poland. The list of out-of-court dispute resolution bodies is kept by the President of UOKiK. Consumers from other EU countries may contact the European Consumer Centre in their country.

§10. Business customers

Towards businesses that do not enjoy consumer rights, liability under statutory warranty (rękojmia) is excluded (Article 558 §1 of the Polish Civil Code). Terms of wholesale cooperation are agreed in a separate contract.

§11. Final provisions

Personal data are processed in accordance with the Privacy policy. Polish law applies to matters not covered here, without prejudice to the mandatory consumer protection rules of the Consumer’s country of habitual residence. Changes to these terms do not affect orders placed before they take effect. In case of discrepancies between language versions, the Polish version prevails, to the extent permitted by mandatory consumer law.
